1.2. Communications: Relevant UK legislation requires that certain information or notices sent to you must be in writing. When using our site or ordering Services, you accept that communication with us will be predominantly electronic. We will contact you by email or issue notifications directly within your Blended Hosts Client Portal. For contractual purposes, you agree to this electronic means of communication and acknowledge that all contracts, notices, and operational notifications satisfy all statutory requirements for written communication. Marketing newsletters are entirely optional, kept separate from transactional communications, and may be configured at any time via your account settings.
1.3. Governing Law: Contracts for the purchase of Services through our website are governed exclusively by the laws of England and Wales. Any dispute arising from, or related to, such Contracts shall be subject to the exclusive jurisdiction of the courts of England and Wales. English is the sole language offered for the conclusion of contracts.
2. Customer Status and Warranties
2.1. Warranties: By placing an order through our website or Client Portal, you warrant that:
- (a) You are legally capable of entering into binding contracts;
- (b) You are at least 18 years of age; and
- (c) All information provided during account creation and checkout is accurate, complete, and maintained up to date.
2.2. Corporate Authority: If you place an order on behalf of a company, partnership, sole trader, charity, or other legal organisation, you warrant that you possess full legal authority to bind that organisation to these Terms and Conditions.
2.3. Account Security: You are responsible for preserving the confidentiality of your account credentials, login email, passwords, and two-factor authentication (2FA) mechanisms. You must notify us immediately at help@blendedhosts.co.uk if you suspect unauthorised access to your account. We reserve the right to suspend access to your account if we reasonably believe your account details are compromised or fraudulent.
3. Order Placement, Contract Formation, and Acceptance
3.1. Order Review: Prior to submitting an order, you will be shown an on-screen summary itemising the Services selected, applicable 20% UK VAT, and recurring monthly fees. You will have the opportunity to review and amend details before completing the transaction.
3.2. Contract Formation: Your order constitutes an offer to purchase Services from us. The Contract between us (“Contract”) is formed only when we issue an electronic order confirmation and service provisioning notification (“Acceptance Confirmation”). We reserve the right to decline any order for any lawful reason prior to issuing the Acceptance Confirmation.
3.3. Scope of Contract: The Contract relates only to those specific Services confirmed in the Acceptance Confirmation. We are under no obligation to supply additional services until they have been formally confirmed in writing.
3.4. Third-Party Links: Links provided across our website to third-party services or vendors are provided solely for your convenience. We do not warrant the quality or performance of goods or services procured directly from external third parties.
4. Consumer Rights & Statutory Cooling-Off (Consumers Only)
4.1. Statutory Cancellation Window: If you enter into a Contract as a “Consumer” (an individual acting wholly or mainly outside your trade, business, craft, or profession), you ordinarily have the statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel the Contract within fourteen (14) calendar days beginning the day after receiving your Acceptance Confirmation.
4.2. Immediate Performance Consent: In accordance with Regulation 36 of the Consumer Contracts Regulations 2013, by placing an order and requesting immediate activation of digital web hosting, server provisioning, or domain registration, you give your express consent for service performance to begin immediately upon checkout. You acknowledge that if the digital service is fully provisioned or activated within the 14-day cancellation period, your right to cancel under the statutory cooling-off regulations is waived.
4.3. Statutory Rights Preserved: Nothing in this section limits your statutory remedies under the Consumer Rights Act 2015 regarding digital content or services that fail to meet statutory quality or skill standards.
5. Voluntary 30-Day Money-Back Guarantee (Web Hosting)
5.1. Guarantee Scope: In addition to statutory consumer protections, Blended Hosts provides a voluntary 30-Day Money-Back Guarantee on eligible Shared Linux Cloud, Shared Windows Cloud, and Managed WordPress hosting subscriptions.
5.2. Claim Period: If you are not satisfied with your eligible hosting plan, you may cancel within thirty (30) calendar days beginning on the day after your initial Acceptance Confirmation was issued. You will receive a full refund of the recurring subscription fee paid for that hosting service.
5.3. Cancellation Method: To claim under this guarantee, you must raise a cancellation request via an online support ticket within your Blended Hosts Client Portal before the end of the 30-day period. Because account cancellation triggers automated data removal, you must re-confirm your cancellation request upon receiving our automated confirmation before the refund is executed.
5.4. Excluded Services: The voluntary 30-day guarantee applies strictly to recurring web hosting fees. It explicitly excludes:
- (a) Domain name registrations, renewals, and incoming registry transfer fees;
- (b) Premium, Wildcard, or commercial SSL certificates;
- (c) Virtual Private Servers (VPS) and associated compute resources;
- (d) Custom website migrations, administrative time, or bespoke setup services;
- (e) Third-party add-ons or software licensing fees.
5.5. Fair Use Limit: The 30-day money-back guarantee is limited to one claim per customer, household, or corporate entity.
6. Transparent Pricing, VAT, and Billing Terms
6.1. VAT-Inclusive Quoted Rates: All retail prices quoted across our public website, marketing materials, and comparison charts include UK Value Added Tax (VAT) at the prevailing statutory rate (20%), unless explicitly stated otherwise for enterprise or wholesale accounts. The checkout breakdown itemises the net price, applicable VAT, and total due before payment authorisation.
6.2. No Teaser Rates or Renewal Jumps: Blended Hosts does not employ artificial introductory teaser rates that automatically double, triple, or quadruple upon renewal. Services are billed on an ongoing, transparent subscription basis at the standard catalogue rate agreed upon order activation.
6.3. Price Adjustments and Modifications:
- (a) Subscriptions are billed on an ongoing rolling basis at the standard rate agreed upon order activation. Blended Hosts reserves the right to review and adjust subscription rates to reflect changes in operational overheads, software licensing, central registry increases, taxation, or general inflation.
- (b) Any price adjustment will be communicated to the Customer in writing (via email) at least thirty (30) calendar days prior to taking effect.
- (c) Continued use of the Services after the effective date of a price revision constitutes acceptance of the updated pricing. If the Customer does not agree to a price adjustment, they retain the absolute right to cancel their rolling subscription without penalty prior to the effective date of the new rate.
6.4. Pricing Errors: While we make every effort to maintain accurate pricing, an error may occasionally occur. If a service’s correct price is higher than the rate displayed on our website, we will contact you for instructions before accepting your order or reject the order and provide a full refund. We are under no obligation to supply services at an incorrect (lower) price if the pricing mistake is obvious, unmistakable, and could have reasonably been recognised as a mispricing.
6.5. Recurring Billing: Rolling subscriptions are charged monthly in advance using the credit card, debit card, or direct debit mandate registered to your customer account. Recurring charges are processed on the monthly anniversary of your original service activation date.
6.6. Non-Payment and Suspension: Time of payment is of the essence. If an automated recurring payment fails, we will notify you by email. If payment remains outstanding for more than seven (7) calendar days from the invoice due date, we reserve the right to suspend hosting services. We reserve the right to recover outstanding balances through external debt recovery agencies where necessary, and you agree to cover all reasonable administrative and legal costs associated with such recovery.
7. Duration, Rolling Subscriptions, and Cancellation
7.1. Rolling Monthly Terms: Unless an explicit multi-month or annual prepayment term is selected during order submission, all hosting services operate on flexible rolling monthly agreements.
7.2. Customer Cancellation: You may terminate your rolling monthly hosting agreement at any time directly through the Blended Hosts Client Portal prior to your next monthly renewal invoice generation date. There are zero cancellation or exit fees.
7.3. Mid-Cycle Cancellations: Cancellation takes effect at the conclusion of your current paid billing period. We do not provide pro-rata refunds for unused portions of an active monthly billing period, except where cancellation is exercised under our voluntary 30-Day Money-Back Guarantee or applicable statutory consumer rights.
7.4. Termination by Blended Hosts:
- (a) Without prejudice to any other rights under these terms, we may terminate any Contract without cause by giving you at least thirty (30) calendar days’ advance notice in writing via email. In such circumstances, a pro-rata refund will be issued for any prepaid, unexpired service term.
- (b) If you breach any material term of these Terms and Conditions or our Acceptable Use Policy, we may terminate the Contract or suspend services immediately or upon seven (7) days’ written notice, without entitlement to a refund.
7.5. Data Deletion Upon Cancellation: Upon the effective termination or cancellation of your hosting service, all associated website files, email accounts, databases, and automated backups will be permanently deleted from our servers in accordance with standard data hygiene procedures. You are solely responsible for exporting and securing independent, off-site copies of all data prior to the effective cancellation date.
8. Domain Name Registration, Renewals, and Registry Parity
8.1. Wholesale Parity Policy: Standard retail renewal rates for domain names match our published standard registration pricing with zero artificial retail markup hikes. However, domain pricing remains subject to underlying wholesale fee revisions instituted by central registry operators (including Nominet for .uk/.co.uk domains and ICANN/Verisign for generic TLDs). Any industry-wide wholesale registry increases will be reflected directly in our annual renewal pricing.
8.2. Registrar Agency: In procuring domain registrations, transfers, or renewals, Blended Hosts acts as an intermediary. The registration and ongoing maintenance of any domain name are subject to the terms and conditions of the relevant central registry authority (for example, Nominet UK’s Terms and Conditions for .uk, .co.uk, and .org.uk domains). We will make all reasonable commercial efforts to procure requested domain names, but do not warrant that the chosen domain is available or acceptable to the relevant registry.
8.3. Warranty of Non-Infringement: You confirm and warrant that you are the lawful owner of any trade mark or have full legal permission to register and use the requested domain name, and that your registration and use of the domain name does not infringe the intellectual property or legal rights of any third party.
8.4. Automated Annual Renewal: To prevent accidental domain expiration, domain names renew automatically on an annual basis using the primary payment method registered to your account. We will issue automated renewal notifications via email thirty (30) days and seven (7) days prior to the renewal date. If you do not wish to renew your domain name, you must disable auto-renewal within your Client Portal at least forty-eight (48) hours prior to the scheduled renewal date.
8.5. Free Transfers and Tag Updates: Blended Hosts does not charge exit fees, administrative release charges, or Nominet IPS TAG update fees for transferring domains to another registrar.
9. Cloud Platform Architecture and Resource Usage
9.1. Autoscaling Elasticity: Blended Hosts shared cloud hosting operates on an elastic multi-server cloud cluster. Dynamic load balancers provision compute resources across server pools to absorb visitor surges without rigid single-server LVE throttling.
9.2. Fair Resource Use: Standard web hosting plans include unmetered bandwidth allowances for legitimate, standard business website operations. However, shared hosting resources may not be utilised for:
- (a) Bulk public file sharing, file distribution hubs, or torrent tracking/seeding;
- (b) Uninterrupted video/audio streaming distribution or external streaming relays;
- (c) Off-site system backup storage or cold file archiving;
- (d) Running cryptocurrency mining, automated bots, scrapers, or illegal activities.
9.3. Cluster Protection: If a website generates abnormal, runaway database queries or sustained server loads that degrade cluster performance for other users, we will attempt to contact you to resolve the bottleneck or recommend a transition to an isolated VPS. We reserve the right to temporarily throttle, optimise, or isolate offending processes to preserve platform stability.
9.4. Email Hygiene: Standard email hosting accounts that have not been accessed by POP3, IMAP, or webmail for one hundred (100) consecutive days may be flagged as abandoned and purged to prevent spam accumulation and maintain system performance.
10. Automated Backups and Customer Data Responsibilities
10.1. Automated 30-Day Timeline Backups: Eligible cloud hosting packages include access to automated daily snapshot backups retained for up to thirty (30) calendar days. Customers can perform self-service 1-click restorations of individual files, folders, and MySQL databases directly through the Blended Hosts Control Panel.
10.2. Customer Backup Responsibility: Automated snapshot backups are provided as an operational convenience and do not constitute an independent, disaster-recovery insurance policy. You retain full legal and operational responsibility for maintaining regular, verified, independent off-site backup copies of all website content, media, databases, and configuration settings.
10.3. Limitation of Backup Liability: To the maximum extent permitted by English law, Blended Hosts will not be liable for any loss, corruption, alteration, or accidental disclosure of data resulting from customer error, CMS misconfiguration, unauthorised account compromise, outdated third-party scripts, or third-party exploits.
11. Technical Support Scope and Availability
11.1. Support Inclusions: Our support team assists with platform availability, server hardware, Blended Hosts Control Panel navigation, mail server routing, standard DNS records, and network performance.
11.2. Support Channels:
- (a) Client Portal Tickets: Monitored 24 hours a day, 7 days a week, 365 days a year for high-priority technical issues.
- (b) Telephone Support: Direct assistance is available on +44 (0)333 335 5620 during standard UK business hours (Monday to Friday, 9:00 AM – 5:30 PM GMT), excluding recognised UK public holidays.
- (c) Email Support: Available via help@blendedhosts.co.uk.
11.3. Support Exclusions: Support does not cover custom HTML/CSS/PHP code development, custom database schema debugging, bespoke application development, or fixing errors introduced by unmaintained third-party WordPress plugins or themes.
12. Intellectual Property Rights and Content Indemnification
12.1. Customer Ownership: You retain all intellectual property rights in the content, data, and software you upload to our servers (“Customer Material”). You grant Blended Digital Limited a worldwide, non-exclusive, royalty-free licence to store, transfer, cache, and publish Customer Material solely to the extent necessary to provide the Services.
12.2. Warranty of Non-Infringement: You warrant that Customer Material does not infringe the intellectual property rights, trade marks, or copyrights of any third party and complies with all applicable UK defamation, privacy, and obscenity laws.
12.3. Customer Indemnity: You agree to defend, indemnify, and hold harmless Blended Digital Limited, its directors, officers, and employees against any losses, liabilities, claims, damages, expenses, and legal fees arising out of your use of the Services or any claim that Customer Material infringes third-party rights.
12.4. Platform Licensing: All intellectual property rights in our control panel software, proprietary platforms, and infrastructure remain the exclusive property of Blended Digital Limited or its software licensors. You must not decompile, reverse-engineer, or disassemble any part of the hosting environment or software provided.
13. Service Level, Warranties, and Limitation of Liability
13.1. Service Standard: We warrant that Services will be performed with reasonable care and skill in accordance with recognised industry standards. While we target 99.9% network availability across our UK facilities, we do not warrant that access will be entirely uninterrupted, error-free, or immune to external distributed denial-of-service (DDoS) incidents.
13.2. Consequential Damages Exclusion: To the maximum extent permitted by applicable law, Blended Digital Limited shall not be liable to the Customer (whether in contract, tort, negligence, or breach of statutory duty) for:
- (a) Loss of actual or anticipated income, revenue, or sales;
- (b) Loss of business opportunities, contracts, or commercial deals;
- (c) Loss of profits or anticipated savings;
- (d) Loss of reputation, commercial goodwill, or wasted management time;
- (e) Any indirect, special, punitive, or consequential loss or damage.
13.3. Financial Liability Cap: Our maximum aggregate financial liability under or in connection with any Contract, whether arising in contract, tort (including negligence), or otherwise, shall in all circumstances be strictly limited to one hundred percent (100%) of the total fees paid by the Customer for the specific Service in question during the twelve (12) months immediately preceding the event giving rise to liability.
13.4. Mandatory Statutory Exceptions: Nothing in these Terms excludes or limits our liability for:
- (a) Death or personal injury caused by our negligence;
- (b) Fraud or fraudulent misrepresentation;
- (c) Any other liability that cannot lawfully be excluded or limited under the laws of England and Wales.
14. Events Outside Our Control (Force Majeure)
14.1. Force Majeure: We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the Contract caused by events outside our reasonable control (“Force Majeure Event”).
14.2. Defined Events: A Force Majeure Event includes, without limitation: strikes, industrial action, civil commotion, riot, invasion, terrorist incident or threat, war, fire, explosion, storm, flood, earthquake, natural disaster, global pandemic, localised power outages, breakdown or disruption of public or private telecommunications networks, or legislative actions of governmental authorities.
14.3. Suspension: Performance under the Contract is deemed suspended for the duration of the Force Majeure Event, and we will receive an extension of time for performance commensurate with the duration of the interruption.
15. General Provisions and Entire Agreement
15.1. Severability: If any provision or clause of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable to any extent, that specific term will be severed from the remaining clauses, which will continue to remain valid and enforceable to the fullest extent permitted by law.
15.2. Waiver: No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right, nor shall it prevent or restrict further exercise of that right.
15.3. Assignment: You may not assign, transfer, or subcontract your rights or obligations under the Contract without our prior written consent. We reserve the right to assign, transfer, or subcontract any of our rights or obligations under this Contract.
15.4. Third-Party Rights: The Contracts (Rights of Third Parties) Act 1999 shall not apply to any Contract formed between us, and no third party shall possess any right to enforce any of its terms.
15.5. Entire Agreement: These Terms and Conditions, together with our Acceptable Use Policy and Privacy Policy, constitute the entire agreement between you and Blended Digital Limited regarding the Services and supersede all prior discussions, representations, or understandings.
15.6. Amendments: We reserve the right to revise and amend these Terms and Conditions to reflect regulatory updates, security standards, and platform developments. Updated terms will be published on our website. Customers on active rolling subscriptions will receive thirty (30) calendar days’ advance written notice of any material operational changes affecting their ongoing service.
